Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are entered into by and between you and Edpire ("Company", "we", "us"). By accessing or using the Edpire platform, you accept and agree to be bound by these Terms and our Privacy Policy.

Please read these Terms carefully before using the platform. If you do not agree, do not use the platform.

2. Accessing the Platform

We reserve the right to modify, suspend, or discontinue the platform at any time without notice. We may restrict access to certain features to specific subscription plans or user roles. You are responsible for maintaining the confidentiality of your account credentials.

3. Intellectual Property Rights

The Edpire platform, including its software, design, and content, is owned by the Company and protected by copyright, trademark, and other intellectual property laws. You retain ownership of assessment content you create using the platform. By uploading content, you grant Edpire a limited license to store, display, and process it solely to deliver the service.

4. Prohibited Uses

You agree not to:

  • Violate any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the platform or its infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the platform.
  • Use the platform to transmit spam, malware, or harmful content.
  • Impersonate any person or entity.
  • Use automated tools to scrape or extract data without written permission.

5. Data Processing (GDPR)

When you use Edpire to administer assessments to learners, you act as the Data Controller and Edpire acts as the Data Processor under Article 28 of the GDPR.

  • You are responsible for having a lawful basis to collect and submit learner personal data to the platform.
  • You must obtain any required consents from learners or their guardians before submitting their data.
  • Edpire will process learner data only according to your instructions and the terms of our Data Processing Agreement (DPA).
  • You may request a countersigned DPA by emailing privacy@edpire.com.

6. Reliance on Information

The information provided through the platform is for educational and assessment purposes. We do not warrant the accuracy of AI-generated grading feedback and recommend human review for high-stakes decisions.

7. Limitation of Liability

To the maximum extent permitted by law, Edpire shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the fees paid by you in the 12 months prior to the claim.

8. Termination

You may terminate your account at any time by deleting it from your account settings. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your data will be deleted according to our retention policy described in the Privacy Policy.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or a notice on the platform. Continued use after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Edpire is established. Disputes shall be submitted to the competent courts of that jurisdiction.
